All Beta Logos and Designs including BetaWeb are (c) Copyrighted by the National Beta Club and All Rights are Reserved. All data maintained on the System is considered confidential and proprietary to the National Beta Club. Refer below for Section-specific use, ownership and copyright information.
Any unauthorized use of this data, including the downloading of individual data records, is expressly prohibited. Please contact the Beta Club for questions relating to data integrity confidentiality and use. Neither National Beta Club, nor its contractors nor agents including Central Data Corporation (hereafter "Beta") are responsible for the accuracy or integrity of the data maintained on the System, nor is there any express nor implied warranty regarding any aspect or operation of the System (see Disclaimer).

Use of the BuyUpstate System falls under the guidelines of the Beta Club's Acceptable Use Policies, which follow:

  1. "Family-Safe" Content Policy
    Our Policy is to provide only the best professional content.
    If you find anything on the System offensive or in poor taste, please Let Us Know.

  2. Single-User License
    You have been granted a single-user license to use the BetaWeb. You may not share your ID or Password with any other person. No person other than yourself can take any test or complete any form on the BetaWeb. Use of the BetaWeb by a classroom or a group of persons is expressely prohibited, other than the single unlimited-use seat provided to all schools maintaining an active chartered Beta Club, or as otherwise provided in writing by Beta to an educational organization or entity.

  3. BetaWeb Home Web Page Policy
    1stPage Web Home Pages are FREE to all BetaWeb subscribers. There is no cost to you to make a page and later edit it.
    Pages can not contain, or contain links to, any of the following: nudity, sex, pornography, foul language, hate propaganda, anything illegal, mail fraud or pyramid schemes. This includes anything considered Adult material, or, in the exclusive judgement of the Beta Club, is considered "improper".
    You will not place any graphic image(s) on your page considered "improper" by the definition in the preceeding paragraph.
    You can not copy any other page and/or images without prior consent from the originator of the other page and/or images.
    You can not obtain paid advertising for your page. You can not get paid from any outside source to advertise on your page.
    You will not send unsolicited e-mail, spam to newsgroups, or spam to internet search engines which reference your Angelfire page.
    The Beta Club reserves the right to delete any page it deems unacceptable for any reason without prior notice.
    The Beta Club makes no guarantee as to the availability of service.
    A valid e-mail to you must always be accessible from your page or it will be removed.
    The Beta Club reserves the right to change these rules at any time without notice.
    You, as the author of your page(s) take full responsibility for its contents. By creating your page(s) on the BetaWeb, you, as the author, implicitly state and attest that your page(s) contains nothing illegal, pornographic, nor promotes hate group propaganda. As the author, you also state that nothing on your page is copyrighted material and that any links to other servers have been approved by that organization. You agree that the Beta Club has the right (for any reason or no reason) to remove any page. By submitting your pages, you are agreeing to all these conditions.

  4. BetaWeb Test & Quiz Policy
    The tests, services and articles on this site are intended for entertainment, informational and educational purposes only, and by no means can replace medical diagnoses or professional advice. The services are offered free of charge and without any expressed or implied warranties whatsoever. In no event will the Beta Club or other provider of the services offered on this Web site be liable for any damages or consequences whatsoever resulting from direct, indirect, correct or incorrect use of these services, even if the authors have been advised in advance of the possibility of such damages. If you find anything unprofessional or questionable about any of these tests or quizzes
    let us know.
    The Beta Club is not responsible for any testing issues, including ownership and use. Any questions regarding use, copyright or ownership issues should be directed to Beta Club.

  5. Disclaimer Beta is providing this site and it's content on an "AS IS" basis and makes NO representations or warranties of any kind with respect to this site or its contents. Beta disclaims all such representations and warranties, including for example warranties of merchantability and fitness for a particular purpose. In addition, Beta does not represent or warrant that the information accessible via this site is accurate, complete or current. Any pricing or availability information is subject to change without notice.
    Except as specifically stated on this site, the National Beta Club nor any of its directors, employees, contractors, agents (including Central Data Corporation) or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

  6. BetaWeb Links to External Sites
    Beta is solely responsible for the maintenance of all links to sites (URLs) external to the BetaWeb servers. Any questions or issues regarding use or links to external URLs should be directed to Beta. Where you are providing links to your personal Web Page, you are responsible to maintain the standards of content as outlined in this Policy.

  7. BetaWeb E-Mail (Super!Mail) Policy
    Use of the BetaWeb Super!Mail electronic mail system falls under the Mail & Traffic Policies of the Beta Club as defined below. Any unwarranted or improper use will result in the user's permissions and privileges being revoked.

  8. Unwanted Mail Forwarding or "Spamming" Policy
    We expressly prohibit any use of the System for the unsolicitated or unauthorized forwarding of electronic mail or solicitations. This includes engaging in harassment, whether through language, frequency, or size of messages. Beta Club accounts or services may not be used to collect replies to messages sent from another Internet Service Provider, where those messages violate this Acceptable Use Policy or the Acceptable Use Policy of that other provider. Unsolicited commercial advertisements will likely result in account suspension or cancellation. Unsolicited commercial advertisements may be illegal according to 47 USC 227. We reserve the right to back-charge at our standard rates and terms any such unauthorized use and will cooperate in the prosecution of such abuses.

  9. Acceptable Traffic
    Customers are prohibited from transmitting on or through any of Beta's services, any material that is, in our sole discretion, unlawful, obscene, unprofessional, threatening, abusive, libelous, or hateful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national or international law.

  10. Chain Letters
    Chain letters are prohibited on the BetaWEB and the Internet. Posting a chain letter to newsgroups (or via e-mail on the Internet) is inappropriate. If there is money exchanged, they're illegal in the United States according to the United States Postal Service. If you receive a chain letter from a BetaWEB user, report it to postmaster@upstate.net immediately. If you receive a chain letter from someone on the Internet, contact the postmaster at their site (using postmaster@their.domain.name; for example, postmaster@aol.com)

  11. Miscellaneous Policies
    1. The posting of USENET articles must be consistent with the charter and conventions of the newsgroups being posted to. The posting of encoded binary files to USENET newsgroups not specifically named for that purpose is prohibited.
    2. The sending of e-mail to mailing-lists must be consistent with the charter and conventions of the mailing-list.
    3. The posting of a USENET article to a large number of irrelevant newsgroups (commonly referred to as spamming) is prohibited.
    4. Personal accounts are for a single user, and are for interactive use only.
    5. A maximum of one (1) dial-in session may be active at any given time.
    6. Willfully causing or attempting to cause disruptions of Beta's services is prohibited, and Beta will actively seek prosecution of, and legal remedy from, such acts.
    7. Use of an excessive amount of any system resource such that other users are unfairly affected, is considered abusive, and is prohibited.
    8. Unauthorized use of accounts belonging to others is prohibited.
    9. Reasonable precautions to prevent unauthorized access to your account, such as through the use of
      passwords and file protections, must be taken.
    10. The resale of our products and services is not permitted, unless specifically permitted and documented in a written agreement.
    11. Misrepresenting your identity or impersonating others is prohibited, including, but not limited to, forging e-mail or USENET posting header information.

  12. Cancellation of Service
    The Beta Club reserves the right to immediately terminate the services offered to any user of the BetaWeb for any activity considered detrimental to the professional and quality operation of the System or E-City.
    The Beta Club reserves the right to immediately terminate any persons access to the BetaWeb found abusing the terms and conditions of this Policy.   The decision of the Beta Club will be final.

  13. General Provisions
    1. If any provision of this Agreement shall be invalid or unenforceable in any respect for any reason, the validity and enforceability of any such provision in any other respect and of the remaining provisions of the Agreement shall not be in any way impaired.
    2. This Agreement contains the entire agreement of the parties.

  14. Submitting Complaints
    To report a violation of the Beta Club's Acceptable Use Policy, send a complete copy of the offensive or illegal article or e-mail message to postmaster@betaweb.org. You may also want to contact the National Fraud Information Center or the Federal Trade Commission (FTC) Bureau of Consumer Protection at dmedine@ftc.gov, if appropriate.
